What is Wire Fraud?
“Wire Fraud” is a serious federal felony written into the law at 18 U.S.C. § 1343. It carries a maximum possible punishment of 20 years in prison for each count, along with massive fines. Wire fraud charges carry no minimum sentence and so charges can lead to anything from a Not Guilty verdict, to a term of probation, to a long prison sentence.
The term “wire fraud” might lead you to think of computer hackers stealing huge amounts of money, but the law forbidding “wire fraud” applies to a huge variety of alleged misconduct. The wire fraud statute forbids using any electronic communication that crosses state lines – any call, email, fax, or even text message – in execution of a “scheme to defraud.” Because of the wide reach of the law and the severe penalties it can carry, wire fraud charges are some of the more powerful and more frequently used tools of the federal prosecutors.
