What is a Target Letter?
A target letter is a letter from a federal prosecutor saying you are the target of a grand jury investigation.
What does it mean to receive a Target Letter?
In a federal criminal investigation people fall into one of three categories: witness, subject and target. When a federal prosecutor says you are a target, it means law enforcement agents and the federal prosecutor think you did something illegal, and they are investigating you. They may be sending you a target letter to open plea negotiations or to seek a dialogue with you.
If you receive a target letter, you may already know you are under investigation or this may be how you learn about that. Either way, it can be a jarring and difficult letter to receive.
Common mistakes made by recipients of target letters
People who receive a target letter often want to call the prosecutor to explain their side of the story. This is a terrible decision, and anything you say will be used against you. The decision whether to talk with law enforcement or the prosecutor is one that needs to be made very carefully and only after consultation with an experienced criminal defense lawyer.
The target letter may ask you to do one of several things, but the best move is to hire a lawyer and have that lawyer reach out to the prosecutor. The defense team at Gaskins Bennett & Birrell LLP has the experience to help you explain your side of the story in the best possible way. Contact us today.

Having a lawyer before you talk to a police officer or federal agent is one of your rights as an American and it is wise to talk with a lawyer before you try to “go it alone” against powerful and experienced opposing forces.
